The United States democracy is one that is popular among democratic States. The United States democracies uphold the respect for fundamental human rights and tend to protect human liberty and freedom through its constitutional declarations. Thus, the term constitutionalism expresses how public officers are limited in their operations within the dictates of the constitution. The United States constitution advocates for the separation of power of the three arms of government.
The US democracy is based on the principle of separation of power proposed by Charles Montesquieu. Charles Montesquieu in his proposition argues “liberty can only be guaranteed in any political system if the powers of government are separated and allocated to different institutions. According to him if executive, legislative and judicial powers are vested in the same person or institution, there will soon be an end to liberty and absolutism is bound to emerge; “for power corrupts and absolute power corrupts absolutely” (Hazard, 1954, citied in Akhakpe 1999: 32).
